If your “brand” is descriptive of your product, other traders will also be entitled to use the word or symbol to describe their goods or services. The “brand” will not then be your exclusive badge of origin, and your rights to stop others from using it will either be non-existent or extremely limited. It's all a matter of degree and there is a fine line between what is considered distinctive, and therefore registrable as a Trade Mark, and what is too descriptive to merit registration. To put this into context, the word DIESEL is a fine Trade Mark for fashion but would not be accepted for fuel.
